Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and RunAI ("Company," "we," "us," or "our") governing your access to and use of the RunAI mobile application and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Description of Service

RunAI is an AI-powered running coach that provides personalized training insights, workout recommendations, and performance analysis. The Service includes:

• AI coaching through natural language conversations
• Integration with Strava for automatic activity synchronization
• Training plan creation and management
• Performance tracking and analytics
• Goal setting and progress monitoring

Account Requirements

To use RunAI, you must:

1. Be at least 13 years of age
2. Have a valid Strava account to connect your running data
3. Provide accurate and complete information when creating your account
4. Maintain the security of your account credentials
5. Promptly notify us of any unauthorized use of your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

Subscription and Billing

Free Trial

New users receive a 30-day free trial with full access to all features. No payment information is required to start your trial. At the end of the trial period, you will need to subscribe to continue using the Service.

Subscription Plans

We offer monthly and annual subscription plans. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew unless cancelled before the renewal date.

Payment Processing

All payments are processed through the Apple App Store or Google Play Store, depending on your device. Payment terms are subject to the respective app store's terms and conditions.

Cancellation

You may cancel your subscription at any time through your app store account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period. Refunds are handled according to the policies of the Apple App Store or Google Play Store.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service for any commercial purpose without our prior written consent
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Use any automated means to access the Service or collect data from it
• Transmit any malicious code, viruses, or harmful content
• Impersonate any person or entity or misrepresent your affiliation
• Share your account credentials with others
• Use the Service in any way that violates applicable laws or regulations

AI Coaching Disclaimer

You acknowledge and agree that:

• The AI coach is not a licensed medical professional, personal trainer, or coach
• Training recommendations are generated by artificial intelligence and may not be suitable for your specific circumstances
• You should listen to your body and stop exercising if you experience pain, dizziness, or discomfort
• Pre-existing medical conditions may affect your ability to follow training recommendations safely
• We are not responsible for any injuries or health issues that may result from following AI-generated advice

Intellectual Property

The Service and its original content, features, and functionality are owned by RunAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you submit to the Service (such as chat messages and training notes). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing the Service.

Third-Party Services

The Service integrates with third-party services including Strava, RevenueCat, and Anthropic. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the content, policies, or practices of any third-party services.

Limitation of Liability

To the maximum extent permitted by applicable law, RunAI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Personal injury or property damage resulting from your use of the Service
• Any unauthorized access to or use of our servers or personal information

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Service.

Indemnification

You agree to defend, indemnify, and hold harmless RunAI and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Service

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service and cancel your subscription.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RunAI operates, without regard to its conflict of law provisions.
